Big West went around with the Macross copyright with MII, M+ and M7 (and MD7) so why didn't Tatsunoko step in back then. So that's why it doesn't appear correct to say "Tatsunoko thought they had more...". If they did, they would have stepped up back then. When Tatsunoko challenged Bandai (with Big West as Bandai's supporter), they were in essence, trying to control the distribution of the "Macross-franchise". In that case, the court ruled that since their company had zero participation in those later works, they were not entitled to any royalties and the court dismissed the suit (simply, no work, no money). That is correct. They can make comics and toys using stuff from SDFM because that's merchandising and falls with their trademark. But the moment they attempt to create a derivative work (like the works you mentioned) using those designs, then it gets very messy.

After reading the reviews here and review blogs, I'm inclined to follow the "wait for the DVD"-approach to watch it (that is of course, if I could watch it in theaters ). It doesn't feel like a DYRL but more like a Gundam Special Edition-type flick. It's probably the fact that old animation is mixed with new and the weaving of TV and movie parts together. Well, it's said, no one was minding the store when M+ and MII came out. But as of now, HG owns the US and Europe trademark to "Macross". Anybody who attempts to bring any Macross over other than HG would be in violation of that trademark (and HG would win that outcome).
