If it is a plain auction, you can probably report it to eBay, since the seller has made a commitment to auction the item, and there were only a few valid reasons to pull an auction - item was damaged, there was an error in the listing, etc. "Out of Stock" was definitely not one of the few valid excuses to pull an auction. You know when you open a new artbook, there's that distinct smell? Well the bootleg has that same feel and smell! and the picture is damn near the original. Only difference I found was again the book cover. It's not as thick and glossy like the original.
